1. Overview
This Privacy Policy explains how FKNStudio ("FKNStudio", "we", "us", or "our") collects, uses, discloses, and protects information when you visit fknstudio.com or use our platform for generating, scheduling, and publishing AI-assisted short-form content such as slideshows and faceless videos (the "Service").
By creating an account or using the Service, you agree to the collection and use of information in accordance with this policy. If you do not agree, please do not use the Service.
2. Information We Collect
Account information
When you create an account we collect your email address and password. If you sign in with Google, we receive your name, email address, and profile picture from your Google account.
Brand and workspace information
Information you provide about the brands you manage, such as brand names, websites, niche, target audience, brand voice, call-to-action details, and brand colors.
Content and media
Topics, scripts, captions, hashtags, and other content you create or that is generated for you, along with generated slideshow images and videos. This includes logos and other media you upload, which are stored privately on your behalf.
Connected accounts
If you connect a TikTok account for publishing, we store the connection details and authorization tokens needed to post to that account on your instruction.
Usage and analytics data
We collect information about how you use the Service, including pages viewed, features used, and actions taken (such as generating or publishing content), plus standard technical data such as IP address, browser type, device type, and referring URLs.
Communications
If you contact us or receive transactional emails from us, we keep a record of those communications, including email delivery events such as sends, opens, and bounces.
3. How We Use Your Information
- Providing, operating, and maintaining the Service, including generating slideshows and videos, storing your brand settings and media, and publishing content you approve.
- Personalizing generated content to your brand, niche, and audience.
- Scheduling and posting content to the social accounts you connect, only at your direction or under automations you configure.
- Showing you analytics about how your published content performs.
- Sending service-related communications, such as account confirmations, password resets, and publishing failure alerts.
- Sending optional product updates and marketing emails only where you have opted in; every marketing email includes an unsubscribe link.
- Monitoring usage, detecting fraud and abuse, and keeping the Service secure.
- Complying with legal obligations and enforcing our terms.
We do not use your content or your brand data to train third-party AI models without your consent.
4. AI Generation and Processing
The Service uses artificial intelligence to draft topics, scripts, captions, and hashtags, and to assemble images into branded slideshows and videos. To do this, the topics, scripts, and brand information relevant to a generation are sent to AI model providers that process the request on our behalf.
These providers process content solely to deliver the generation you asked for. We select providers that do not use customer inputs to train their models for our individual and business plans. You are responsible for reviewing generated content before publishing it, and for ensuring you have the right to publish it.
AI outputs may be inaccurate or may resemble existing works. You should review every script and preview before approving content for publication.
5. Third-Party Services
We share information with the following categories of service providers, who process it on our behalf:
- Hosting, database, authentication, and storage providers that run the Service and store your account data and media.
- AI model providers used for script and content generation, and AI voice providers (such as ElevenLabs) used when you request AI narration.
- Stock media providers (Pexels, Pixabay) whose APIs supply images and music for your content.
- Publishing partners used to deliver approved content to connected social accounts such as TikTok. When you approve a post, the necessary content and connection details are transmitted to publish it.
- Analytics providers (Google Analytics) that help us understand how the Service is used.
- Email delivery providers that send transactional and marketing emails from notify.fknstudio.com.
These providers act under contract and are permitted to use your information only to provide services to us. We may also disclose information if required by law, legal process, or to protect the rights, property, or safety of FKNStudio, our users, or others, or in connection with a merger, acquisition, or sale of assets, in which case we will notify you as required by law.
8. Data Retention
We keep your account and content data for as long as your account is active or as needed to provide the Service. If you delete a brand, slideshow, video, or uploaded media, the underlying files are deleted from our storage.
If you request account deletion, we delete your account data and content. Some data may be retained in backups for a limited period (up to 30 days) or where required by law, and minimal records may be kept to comply with legal, accounting, or dispute-resolution obligations.
9. Data Security
We use industry-standard safeguards, including encryption in transit, access controls, and row-level database permissions that scope every user's access to their own data. Uploaded logos and generated media are stored privately and served only to you via expiring signed URLs.
No method of transmission or storage is completely secure, and we cannot guarantee absolute security. If we learn of a data breach affecting your personal information, we will notify you and applicable regulators as required by law.
10. Your Rights
For users in the EU, UK, and Switzerland (GDPR)
You have the right to access, rectify, erase, restrict, and port your personal data, to object to processing based on legitimate interests, and to withdraw consent at any time where processing is based on consent. You may also lodge a complaint with your local data protection authority. Our legal bases for processing are: performance of a contract (providing the Service), legitimate interests (security, analytics, product improvement), and consent (marketing emails, optional features).
For California residents (CCPA/CPRA)
You have the right to know what personal information we collect and how it is used and shared, the right to access and delete your personal information, the right to correct inaccurate personal information, and the right to non-discrimination for exercising these rights. We do not sell or share personal information as defined by the CCPA, so opt-out of sale tools are not required. You may designate an authorized agent to make requests on your behalf.
To exercise any of these rights, email us at support@fknstudio.com. We will verify your identity before fulfilling requests and respond within the timeframes required by applicable law. You will not be discriminated against for exercising your rights.
11. International Data Transfers
FKNStudio operates globally, and your information may be processed in the United States and other countries that may have different data protection laws than your jurisdiction. Where we transfer personal data out of the EEA or UK, we rely on appropriate safeguards such as standard contractual clauses.
12. Children’s Privacy
The Service is not directed to children under 16 (or under 13 in the United States, or the higher age required by local law). We do not knowingly collect personal information from children. If you believe a child has provided us with personal information, contact us and we will delete it.
13. Changes to This Policy
We may update this Privacy Policy from time to time. When we make material changes, we will notify you by email or through a notice in the Service, and update the "Last updated" date above. Continued use of the Service after changes take effect constitutes acceptance of the revised policy.
